1. Agreement to Terms

By accessing or using ux.gold ("Service"), operated by UX Technologies ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

ux.gold provides streaming tools and services for content creators, including but not limited to:

• SRT/SRTLA streaming relay infrastructure
• Real-time translation and subtitle services
• Remote OBS control functionality
• Related streaming tools and utilities

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these terms.

4. Payment and Billing

Certain services require payment. By purchasing a service, you agree that:

• You authorize us to charge your payment method for the fees indicated
• Subscription fees are billed in advance on a recurring basis
• Credit-based services (such as translation credits) are consumed as used
• All fees are non-refundable except as specified in our Refund Policy
• We may change our pricing with 30 days notice

Payments are processed through Stripe. By making a payment, you also agree to Stripe's terms of service.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Stream content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Infringe on intellectual property rights of others
• Transmit malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or servers
• Resell, redistribute, or provide access to the Service to third parties without authorization
• Use the Service for any commercial purpose not expressly permitted

6. Content and Intellectual Property

You retain ownership of any content you stream or create using our Service. By using our Service, you grant us a limited license to process and transmit your content as necessary to provide the Service.

ux.gold, its logo, and all related names, trademarks, and service marks are the property of UX Technologies. You may not use our branding without prior written permission.

7. Third-Party Services

Our Service integrates with third-party platforms including Twitch, YouTube, Kick, and Discord. Your use of these platforms is subject to their respective terms of service. We are not responsible for the availability, content, or practices of third-party services.

8. Service Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted service. We are not liable for any downtime, interruptions, or data loss. Technical support is provided on a best-effort basis via email.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UX.GOLD AND USTA ENTERPRISE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless ux.gold and UX Technologies from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Tokyo, Japan.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
